1. Eligibility & Account

• You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services.
• You are responsible for your account credentials and all activity under your account.
• You agree to provide accurate information and keep it up to date.

2. The Services

Photomatic provides AI-powered photo and video editing, generation and design tools across web and mobile. Features, models and tools may change, be added or be removed over time.

Some features rely on third-party AI models; their availability and behavior may vary.

3. Your Content

• You retain ownership of the content you upload.
• You grant us a limited license to host, process and transform your content solely to provide the Services to you.
• You are responsible for ensuring you have the rights to the content you upload and that it does not infringe others’ rights or violate any law.

4. AI-Generated Output

• Subject to your plan and applicable law, outputs you create are yours to use, including for commercial purposes.
• AI output may be imperfect or unexpected; you are responsible for reviewing results before use.
• Output generated via third-party models may be subject to those providers’ terms.

5. Acceptable Use

• Do not upload or generate content that is illegal, infringing, harmful, hateful, sexually exploitative, or that violates others’ privacy or rights.
• Do not use the Services to create deceptive deepfakes or impersonate others without consent.
• Do not attempt to reverse engineer, scrape, overload or disrupt the Services or their AI systems.
• Do not resell or redistribute the Services without our permission.

6. Subscriptions, Credits & Pricing

The Services offer subscription plans and credit packs. Available plans, prices and currencies are shown dynamically at the point of purchase and may vary by region, platform, promotion and over time. The price displayed to you at checkout is the price that applies to your purchase.

Subscriptions renew automatically for the chosen period until cancelled. Credits and plan benefits are consumed as you use AI features.

7. Billing & Cancellation

• Purchases made through an app store (Apple App Store, Google Play) are billed and managed by that store, subject to its terms.
• Web purchases are billed by our payment providers — Razorpay and/or Paddle, depending on your region. Where Paddle acts as merchant of record, it handles billing, tax and receipts.
• You can cancel a subscription at any time; access continues until the end of the current billing period.
• Refunds are handled per our Refund Policy and the applicable app-store or payment-provider rules.

8. Third-Party Services

The Services integrate third-party providers (for example, for sign-in, payments, analytics and AI processing). Your use of those features may also be subject to the third parties’ terms and policies.

9. Intellectual Property

The Services, including software, design, branding and trademarks, are owned by Photomatic and protected by law. These Terms grant you no ownership of the Services themselves.

10. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind. We do not warrant that the Services will be uninterrupted, error-free or that results will meet your expectations.

11. Limitation of Liability

To the maximum extent permitted by law, Photomatic shall not be liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill arising from your use of the Services. Our total liability is limited to the amount you paid us in the 12 months before the claim.

12. Termination

We may suspend or terminate your access if you breach these Terms or use the Services unlawfully. You may stop using the Services and delete your account at any time.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new date and, where appropriate, notified in-app or by email. Continued use after changes means you accept the updated Terms.

14. Governing Law & Contact

These Terms are governed by the laws of the jurisdiction in which Photomatic operates, without regard to conflict-of-law rules. For questions, contact [email protected].
